Terms of service
you can actually read.
Everything here matches what the rest of the site says, because there is no version of this where the website says one thing and the contract says another. Rolling monthly. 30 days' notice. No exit fee.
This agreement has not been through a solicitor yet.
It is published early on purpose. It is written from the promises we already make on Who owns your customers?, so you can see the shape of what you will be signing and tell us where it is wrong — but it is a draft, it has not been reviewed by a solicitor, and it is not the document that governs anything.
The agreement we send you before you commit is what governs, and we will send it in plain English before you are asked for anything. If you need the final wording today, ask us through the contact page.
What each side signs up to.
Who this is between
This agreement is between Manto Order — a product of Manto Studio, based in London — and the business named on the order form: your shop. Where it says "you", it means that business, not the person who happens to be holding the tablet.
The registered company name, number and address are added here before launch, along with the definitions a contract needs and this one does not yet have.
What you get
- An ordering website and app in your own name, and the storefront behind them.
- The Manto Till, if you are on the plan that includes it, with the kitchen screen, printing and caller ID.
- The dashboard: menu, prices, opening hours, reporting, and your customer list.
- Menu build, onboarding, staff training and go-live support, at no extra cost.
- Support, on the response times published on the support page.
- New features as they ship, at no extra cost. That is the point of one price.
What it costs
- The weekly price for your plan, per shop, is the one set out in your order form on the day you sign up.
- We take no commission on your own orders — nothing per order and nothing per pound.
- Card payments run at Stripe's published UK rate, as set out in your order form. Payouts arrive every Monday with a statement showing every transaction.
- Hardware is separate, and quoted in your order form — to buy or to rent.
Prices are ex VAT. If we ever change the price of your plan we tell you at least one billing period before it happens, and you can leave on 30 days' notice without penalty rather than accept it.
Paying
Billed weekly in advance by direct debit or card. If a payment fails we tell you and try again before anything else happens; we do not switch a shop off on a Friday night over a bounced payment.
An unpaid invoice is never leverage over your data. There is no lien over a database in English law, and there is none in this agreement either: your customer list stays exportable whatever the billing position.
What you're responsible for
- Your menu: item descriptions, prices, and allergen information. We build the menu from what you give us, and we cannot verify what is in your food.
- Food hygiene, food labelling and every other duty that comes with running a food business. We supply software; you run the kitchen.
- Keeping account logins to the people who should have them, and telling us quickly if one is lost.
- Your storefront's own privacy notice. We write one for you during onboarding — the specimen is published here — and you publish it, but you are the controller and it is yours.
- Your marketing permissions.Holding a customer's number is not permission to text it: that is PECR, it is separate from data protection law, and it catches whoever instigates a campaign as well as whoever sends it. We build the permission trail into every customer record and a campaign will not send to a contact that fails the test — but the decision to market is yours. The detail is here.
Hardware
Bought hardware is yours from the day it is paid for, with the manufacturer's warranty. Rented hardware stays ours: we replace it if it fails through normal use, and it comes back to us in the prepaid box when you leave. Loss or damage beyond fair wear is chargeable at the price on the hardware page.
You are welcome to bring your own kit. If it is compatible we will set it up; if it is not, we will say so before you buy anything.
Uptime and support
We aim to keep the service up whenever your shop is open, and the till is built to keep taking and printing orders when the connection drops, syncing when it returns.
Planned maintenance happens outside service hours wherever it possibly can. Response times are published on the support page so you can hold us to them. The service-credit remedy for missing them is one of the clauses still to be drafted.
Data protection
You are the controller of your customers' personal data and we are your processor. The data processing agreement forms part of this agreement and governs that relationship; where the two disagree about personal data, the data processing agreement wins.
How we handle your own account data, as a controller in our own right, is in the privacy notice.
Ending it
- Rolling monthly. You give 30 days' notice in the app — no phone call, no retention team.
- No exit fee, no remaining months, and no finance agreement, because there never was one.
- Your menu, order history and customer list export in one click, free, before you go and after.
- Rented hardware goes back in the prepaid box we send you.
- Then you tell us to delete or return our copy of your customers' data. You choose which, and we confirm in writing when it is done.
We can end it too, with the same notice, or immediately if the service is being used for something unlawful. Even then, the export and the delete-or-return still happen.
Intellectual property
The software stays ours. Your menu, your photographs, your brand and your customer data stay yours, and we use them only to run your shop and to show it to your customers.
Liability and indemnities
These are the two clauses that must be written by a solicitor and not by us. They will set out the cap, what is excluded, what cannot lawfully be excluded — death or personal injury caused by negligence, and fraud, among others — and who indemnifies whom for what.
Whatever they end up saying, they will not be used to escape the promises made elsewhere on this site about your data.
Force majeure
Neither of us is in breach for failing to do something that a genuinely external event prevents — a power or network failure outside our control, a fire or flood, industrial action we are not party to, or a change in the law. We will tell you what has happened and what we are doing about it, and the obligation resumes when the event does. If it runs past a month, either of us can end the agreement without penalty.
Being short-staffed, having a supplier let us down, or running out of money is not force majeure.
Assignment and subcontracting
You may transfer this agreement to whoever buys your business, with our consent, which we will not withhold unreasonably. That is deliberate: your customer list transfers with the shop as an asset, and the agreement should not be the thing that blocks a sale.
We may subcontract parts of the service — hosting, payments, messaging — but we stay answerable to you for anything a subcontractor does. Sub-processors handling your customers' data are governed by the data processing agreement, which requires us to name them and to tell you before the list changes. We will not transfer this agreement to another company without telling you first.
Notices
Day-to-day, the app and email are how we reach each other. Anything formal — notice to end the agreement, a change to the price, a breach — goes in writing to the email address on your account or to us through the contact page, and takes effect when it arrives. Giving notice to leave is a button in the app, and the app is the record of it.
Severance, waiver and the whole agreement
If a court finds any clause unenforceable, that clause is cut and the rest stands. If either of us lets something slide once, that is not a waiver of the right to enforce it later.
This agreement, the data processing agreement and your order form are the whole of what we have agreed, and they replace anything said during the sales conversation. Nothing here limits liability for a fraudulent misrepresentation.
Third-party rights
This agreement is between us and your shop. Nobody else can enforce it under the Contracts (Rights of Third Parties) Act 1999, and the two of us can vary or end it without anyone else's consent.
Changes to these terms
We will tell you before a material change takes effect, in enough time for you to leave on notice instead of accepting it. We will not change them quietly and re-date the page.
Governing law
This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over it.
Draft of 9 September 2026. PECR is the Privacy and Electronic Communications Regulations, Regulation 22.
